Customer Order Terms
The terms that apply when you order through an Anytable-powered page.
PLEASE READ THESE TERMS BEFORE PLACING AN ORDER. THEY LIMIT ANYTABLE’S LIABILITY, INCLUDE A BINDING ARBITRATION PROVISION AND CLASS ACTION WAIVER (SECTION 11), AND CONTAIN IMPORTANT INFORMATION ABOUT FOOD ALLERGIES (SECTION 5).
These Customer Order Terms (these “Terms”) govern your use of any restaurant ordering page powered by Anytable Inc. (“Anytable,” “we,” “us”) — pages at addresses such as restaurantname.anytable.com (the “Ordering Service”). By placing an order through the Ordering Service, you accept these Terms.
1. Your Contract Is with the Restaurant
Each order you place is a purchase from the independent restaurant identified on the ordering page (the “Restaurant”) — not from Anytable. Anytable provides the technology platform and facilitates payment; it is not a party to your purchase, and it does not prepare, sell, inspect, package, or deliver food. The Restaurant alone determines and is solely responsible for its menu, item descriptions, ingredients, prices, hours, order acceptance, preparation, quality, safety, packaging, fulfillment, and delivery. Questions or concerns about your food should be directed to the Restaurant, whose contact information appears on its ordering page and in your order emails.
2. Placing an Order; Payment
By submitting an order, you make a binding offer to purchase from the Restaurant and authorize a charge to your payment method for the full order total: your items, any delivery fee, applicable tax, any tip you choose to add, and a convenience fee. The convenience fee is Anytable’s platform fee for operating the Ordering Service; it is displayed before you place your order. Prices, fees, and taxes are set or configured by the Restaurant except for the convenience fee, which is set by Anytable.
Payment is processed by Stripe, a third-party payment processor; your full card details are not stored by Anytable or the Restaurant. You represent that you are authorized to use the payment method you provide. You check out as a guest — no account is created and no password is stored.
Tips are passed through in full to the Restaurant; Anytable retains no portion of any tip.
3. Order Communications
We send transactional emails as your order progresses — confirmation and receipt, preparation updates, and ready-for-pickup or out-for-delivery notices. These communications are part of fulfilling your order, and you consent to receive them when you place an order. After a completed order, the Restaurant may also send you a one-time review invitation; you may opt out of review invitations at any time via the link in that email.
4. Preparation Times; Scheduled Orders
Preparation, ready, and delivery times shown or communicated are estimates only and are not guaranteed. Kitchens get busy, and actual times may vary. Where a Restaurant accepts scheduled orders, your payment method is charged when you place the order, and the Restaurant prepares it for your selected time slot; scheduled times are likewise estimates.
5. Food Allergies and Dietary Information — Important
The Restaurant — not Anytable — is solely responsible for its ingredients, allergen information, food-handling practices, and the prevention of cross-contact between foods. Anytable does not prepare food, does not maintain or verify ingredient or allergen information, and cannot ensure that any item is free of any particular allergen or ingredient. Menu descriptions are provided by the Restaurant and may not list every ingredient.
If you have a food allergy, intolerance, or dietary restriction, we strongly recommend that you (a) note it clearly in the order notes when placing your order, and (b) contact the Restaurant directly — before ordering — to confirm that it can accommodate your needs. Do not rely solely on menu descriptions. If your allergy is severe, please consider whether ordering prepared food from any source is appropriate for you.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANYTABLE DISCLAIMS ALL LIABILITY ARISING FROM OR RELATING TO FOOD ALLERGIES, ALLERGIC REACTIONS, INTOLERANCES, INGREDIENT ACCURACY, CROSS-CONTACT, OR ANY ILLNESS OR INJURY ALLEGED TO RESULT FROM FOOD OR BEVERAGES ORDERED THROUGH THE ORDERING SERVICE. ANY SUCH CLAIM LIES SOLELY AGAINST THE RESTAURANT.
6. Cancellations; Refunds
Refunds for an order are determined and issued by the Restaurant through the platform, to your original payment method; bank posting times vary by institution. One protection is automatic: if a Restaurant does not act on your order within its configured time limit, the order is automatically cancelled and you are refunded in full — your money is not held for an order that was never seen. Anytable does not itself adjudicate quality disputes between you and a Restaurant; if something is wrong with an order, contact the Restaurant first, and contact support@anytable.com if you need help with the platform or a payment.
7. Delivery
Where offered, delivery is performed by the Restaurant’s own personnel within a delivery area the Restaurant defines — Anytable provides no delivery services and is not responsible for delivery conduct, timing, or condition of items on arrival. You agree to provide an accurate delivery address, to be reachable at the phone number you provide, and to receive the order at the address given. Incorrect address information may result in delay or non-delivery for which neither Anytable nor the Restaurant is responsible.
8. Your Information
Our collection and use of your information is described in the Anytable Privacy Policy. In summary: your order details are shared with the Restaurant you ordered from (that is the service); payment is processed by Stripe; and ordering pages carry no advertising or analytics trackers. The Restaurant’s own use of your information is governed by its practices and applicable law; the Restaurant is an independent business and is not Anytable’s agent.
9. Acceptable Use; Eligibility
You agree to use the Ordering Service only to place genuine orders for yourself or others with their consent, and not to place fraudulent, abusive, or automated orders; interfere with the Ordering Service; or attempt to circumvent its security. You must be old enough to form a binding contract for your purchase and authorized to use your payment method. The Ordering Service is not directed to children under 13. Anytable may refuse, cancel, or limit orders where it reasonably suspects fraud or misuse.
10. Disclaimers; Limitation of Liability
THE ORDERING SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANYTABLE DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY — INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT — AND ALL RESPONSIBILITY FOR THE FOOD AND BEVERAGES YOU PURCHASE, WHICH ARE PROVIDED SOLELY BY THE RESTAURANT. ANYTABLE DOES NOT WARRANT THAT THE ORDERING SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE OR THAT ANY ORDER WILL BE ACCEPTED OR FULFILLED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) ANYTABLE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THE ORDERING SERVICE OR ANY ORDER; AND (B) ANYTABLE’S TOTAL AGGREGATE LIABILITY IN CONNECTION WITH ANY ORDER WILL NOT EXCEED THE TOTAL AMOUNT YOU PAID FOR THAT ORDER. NOTHING IN THESE TERMS LIMITS THE RESTAURANT’S RESPONSIBILITIES TO YOU AS THE SELLER OF YOUR FOOD, EXCLUDES LIABILITY THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW, OR LIMITS ANY NON-WAIVABLE CONSUMER RIGHTS YOU MAY HAVE.
11. Disputes; Arbitration; Class Action Waiver; Governing Law
Disputes about your food or its fulfillment are between you and the Restaurant. For any dispute between you and Anytable arising out of or relating to the Ordering Service or these Terms, you and Anytable agree: first, to attempt informal resolution by writing to support@anytable.com and allowing 30 days; and, if unresolved, to submit the dispute to final and binding individual arbitration administered by the American Arbitration Association under its applicable rules, seated in Palm Beach County, Florida (with videoconference proceedings available), except that either party may bring an individual claim in small-claims court. YOU AND ANYTABLE EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS OR REPRESENTATIVE ACTION. You may opt out of arbitration by writing to support@anytable.com within 30 days of your first order. These Terms are governed by Florida law, without regard to conflicts of law; for matters not subject to arbitration, exclusive venue lies in the state and federal courts of Palm Beach County, Florida. To the extent permitted by law, claims must be brought within one (1) year of accrual.
12. General
If any provision of these Terms is held unenforceable, the remainder continues in effect. Anytable’s failure to enforce a provision is not a waiver. These Terms are the entire agreement between you and Anytable regarding the Ordering Service, and Anytable may update them from time to time — the version posted at the time you place an order applies to that order. The Restaurant is not a party to any agreement between you and Anytable, and no third-party beneficiary rights are created except that Restaurants may rely on Sections 1, 5, and 10.
